ASCII LAB TERMS OF USE

These Terms of Use ("Terms") govern your access to and use of the ASCII Lab iOS and iPadOS application, its widget, bundled legal and help screens, and related functionality (together, the "Service").
The Service is provided by Maksim Yaromau, Individual Entrepreneur, Georgia IP No. 302239897, legal address: 70 M. Tsinamdzgvrishvili street, Georgia ("ASCII Lab", "we", "us", or "our"). Contact: Yaromaum@gmail.com.
This English version is the official version. Translations are provided for convenience.
1. ACCEPTANCE
By downloading, accessing, purchasing, subscribing to, or using the Service, you confirm that you have read, understood, and agreed to these Terms and the Privacy Policy. If you do not agree, do not use the Service. Deleting the app does not cancel an Apple-managed subscription.
2. AGE AND LEGAL CAPACITY
The Service is available to users of all ages. If you are below the age at which you can enter into a binding agreement in your country, you may use the Service only with permission and supervision from a parent or legal guardian. The parent or guardian is responsible for the minor's use of the Service.
3. WHAT ASCII LAB PROVIDES
ASCII Lab converts photos and videos selected by you into ASCII and terminal-style artwork on your device. It includes local previews and exports, a local conversion library, sharing and Photos export, an optional Home Screen widget, local notifications, Free features, and paid Pro features.
No account is required. ASCII Lab does not operate a backend that receives or renders your media. Availability and performance depend on your device, operating system, selected media, free storage, Apple services, permissions, and purchase status.
4. YOUR MEDIA AND OUTPUTS
You retain ownership of photos, videos, audio, and other content you select, and of your rights in outputs created from that content. You are responsible for ensuring that you have all rights and permissions needed to process, display, save, and share the selected content and outputs.
You grant ASCII Lab only the limited permission necessary to process selected media locally on your device and perform the actions you request. We do not claim ownership of your original media or personal outputs.
Original media is copied only to temporary app storage for editing and is intended to be removed when the editor closes or the source is replaced. Outputs, thumbnails, settings metadata, and widget frames that you save may remain in local app or App Group storage until you delete them, delete the related library item, remove the widget selection, or uninstall the app.
5. FREE AND PRO ACCESS
The Free version currently includes 27 effects, photo export up to 1080 pixels, standard editing controls, the local library, sharing, Photos saving, and widget support. Pro currently adds 52 more effects, photo export up to 2400 pixels, video export up to 30 seconds, and advanced controls including glow, scanlines, frame rate, and audio preservation.
Features and limits may change. Access rules enforced by the version of the app you use control what is available. We do not guarantee that every current feature will remain available forever or on every device.
6. PRODUCTS, TRIALS, AND LIFETIME PURCHASE
ASCII Lab Pro may be offered as automatically renewing weekly or yearly subscriptions and as a one-time lifetime purchase. Eligible subscriptions may include an introductory trial. Eligibility and the exact trial, price, currency, tax, billing period, and renewal terms shown by Apple at purchase time control.
The lifetime purchase unlocks local Pro functionality made available under the ASCII Lab Pro entitlement for the Apple Account used to purchase it. It does not guarantee that unrelated future products, services with material third-party or usage costs, or separately offered content will be included.
7. APPLE BILLING, RENEWAL, CANCELLATION, AND REFUNDS
Purchases are processed by Apple through the App Store. Apple handles payment, billing information, taxes where applicable, renewal, cancellation, and refund workflows. We do not receive your full payment-card number.
Subscriptions renew automatically unless cancelled through your Apple Account before the renewal date specified by Apple. A trial converts to the selected paid subscription unless cancelled before the trial ends under Apple's displayed terms. Deleting ASCII Lab does not cancel a subscription.
Manage or cancel subscriptions using Apple's official subscription settings. Refund requests must be submitted through Apple, including reportaproblem.apple.com or Apple Support. Apple decides refund eligibility under its policies and applicable law; we cannot issue or guarantee App Store refunds.
8. RESTORE PURCHASES
Restore Purchases asks Apple and, when configured, RevenueCat to refresh purchase and entitlement status. It does not create a purchase, cancel a subscription, or request a refund.
9. ACCEPTABLE USE
You agree not to use the Service unlawfully; infringe intellectual-property, privacy, publicity, or other rights; process or share content without permission; distribute harmful, abusive, exploitative, fraudulent, or illegal content; bypass purchase or feature controls; interfere with security or operation; introduce malware; or reverse engineer, scrape, resell, or exploit the Service except where applicable law expressly permits it.
10. ASCII LAB INTELLECTUAL PROPERTY
The Service, including its software, interface, design, name, logos, built-in effects, fonts where licensed, graphics, demonstrations, and documentation, is owned by us or our licensors and protected by applicable laws.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service on Apple devices you own or control as permitted by Apple rules. No rights are granted except those expressly stated.
11. THIRD-PARTY SERVICES
The Service relies on or interacts with third-party services including Apple iOS/iPadOS, App Store, StoreKit, Photos, notifications, sharing, WidgetKit, RevenueCat for purchase entitlement management when configured, and PostHog for privacy-safe analytics in eligible App Store production builds.
Third-party services are governed by their own terms and policies. We are not responsible for their availability, decisions, billing actions, outages, or content.
12. APPLE APP STORE TERMS
These Terms are between you and ASCII Lab, not Apple. Apple is not responsible for the Service or its content. Your use must comply with the Apple Media Services Terms and applicable Apple rules. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it.
If the Service fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, under its policies. To the maximum extent permitted by law, Apple has no other warranty obligation for the Service.
13. PRIVACY
The Privacy Policy explains how data is processed, stored, and disclosed. By using the Service, you acknowledge that processing occurs as described there.
14. SERVICE AVAILABILITY AND CHANGES
We may update, change, suspend, limit, or discontinue any part of the Service. We do not guarantee uninterrupted, secure, error-free, or permanent availability; compatibility with every device, media format, operating-system version, language, region, or Apple Account; or preservation of local data after deletion, device failure, storage loss, or operating-system action.
15. OUTPUT AND PERFORMANCE DISCLAIMER
Output appearance, accuracy, frame timing, color, audio handling, export duration, and quality depend on source media, chosen settings, device hardware, operating-system behavior, storage, and supported codecs. You should review outputs before relying on, publishing, or sharing them and keep separate backups of important media.
16. WARRANTIES
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without express, implied, or statutory warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, non-infringement, or compatibility. Some jurisdictions do not allow certain exclusions, so they may not apply to you.
17. LIMITATION OF LIABILITY
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss or corruption of media, outputs, data, revenue, profits, or goodwill; inability to use the Service; device or storage failure; third-party service actions; or unauthorized use of content you process or share.
To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid for the Service during the 12 months before the claim arose, or USD 50 if you paid nothing, unless applicable law requires a different limit.
18. INDEMNITY
To the extent permitted by law, you agree to defend, indemnify, and hold us harmless from claims, losses, liabilities, costs, and expenses arising from your content, your use or misuse of the Service, your violation of these Terms, or your violation of law or another person's rights.
19. TERMINATION
You may stop using the Service at any time. You must separately cancel an active Apple-managed subscription to prevent future renewals. We may suspend or terminate access where reasonably necessary because of misuse, violation of these Terms or law, security risk, platform requirements, or discontinuation of the Service.
Provisions that by their nature should survive termination will survive, including ownership, disclaimers, liability limits, indemnity, disputes, and Apple billing provisions.
20. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of Georgia, except where mandatory consumer-protection, data-protection, platform, or other laws in your country require otherwise. Before bringing a formal claim, contact us and attempt to resolve the dispute informally. Nothing in these Terms limits mandatory rights available to you.
21. CHANGES TO THESE TERMS
We may update these Terms when the Service, law, or platform requirements change. If required, we will provide notice through the Service or another reasonable method. Updated Terms take effect on the stated effective date. Continued use after that date constitutes acceptance where permitted by law.
