In My Fridge Terms of Use

These Terms of Use ("Terms") govern your access to and use of In My Fridge, including the In My Fridge iOS application, bundled legal screens, related hosted legal and support pages, and services that support the app (together, the "Service").
The Service is provided by Maksim Yaromau, Individual Entrepreneur, Georgia IP No. 302239897, legal address: 70 M. Tsinamdzgvrishvili street, Georgia ("In My Fridge", "we", "us", or "our").

1. Acceptance of these Terms
By downloading, accessing, purchasing, subscribing to, or using the Service, you confirm that you have read, understood, and agreed to these Terms and the Privacy Policy.
If you do not agree, do not use the Service. If you have an active Apple-managed subscription, deleting the app does not cancel it. You must cancel it through Apple.
2. Age requirement
The Service is intended only for users who are at least 13 years old or the minimum age required by law in their country to use online services without parental consent. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
3. What In My Fridge provides
In My Fridge is a cooking and kitchen organization product. The current Service may help you keep a fridge and kitchen inventory, add ingredients and equipment, match recipes to food you have, see missing ingredients, save recipes, track cooked recipes, prepare shopping lists, use timers or cooking steps, set meal or nutrition-related reminders, and review suggested items from receipt or product-photo recognition.
The Service is for personal cooking, grocery, and kitchen planning assistance. It does not provide medical, dietitian, nutritionist, allergy, food-safety, legal, financial, emergency, or other regulated professional advice.
4. No guarantees
Recipe matches, shopping suggestions, recognition results, nutrition values, calorie estimates, cooking instructions, expiration or storage suggestions, and other Service content may be incomplete, outdated, inaccurate, duplicated, unsuitable, or unavailable.
We do not guarantee that any recipe, ingredient match, nutrition value, recognition result, shopping suggestion, food-storage suggestion, reminder, or app output will be accurate, complete, safe, suitable for you, or produce any outcome.
You remain responsible for your cooking decisions, purchases, food handling, ingredient verification, allergy checks, dietary choices, health decisions, and use of the Service.
5. Accounts and device data
Some features may use Sign in with Apple or a local app session. Some features may depend on your device, local app data, internet access, Apple services, RevenueCat entitlement status, device permissions, language settings, or paid access.
You are responsible for the information you provide in the Service, including food inventory, equipment, preferences, excluded foods, nutrition-related setup, shopping-list items, photos, recognition edits, support messages, and saved content.
6. In My Fridge Plus and paid access
In My Fridge may offer paid access called In My Fridge Plus. Plus may unlock higher recognition limits, expanded fridge or kitchen capacity, premium recipe or planning features, and other paid functionality shown in the app.
The current premium entitlement is inmyfridge_plus. RevenueCat is used as the entitlement layer to read purchase and entitlement state from Apple and unlock paid access in the app. RevenueCat does not replace Apple as the billing, cancellation, subscription, or refund authority for App Store purchases.
Apple may display localized prices, taxes, currencies, eligibility, trial terms, introductory offers, promotional offers, and purchase terms in the App Store purchase sheet. The price and terms shown by Apple at the time of purchase are the terms that apply to that purchase.
7. Apple billing, subscriptions, cancellation, and refunds
Purchases made in the iOS app are processed by Apple through the App Store. Apple handles payment processing, billing details, subscription renewal, cancellation mechanics, taxes where applicable, and refund request workflows for App Store purchases.
Subscriptions renew automatically unless cancelled through your Apple account settings before the renewal date. Deleting In My Fridge does not cancel a subscription. You can manage or cancel Apple subscriptions in iOS Settings, your Apple account subscription settings, the App Store account interface, or other official Apple subscription tools.
In My Fridge and the provider do not process refund requests directly, do not issue refunds outside Apple, do not provide cash or off-platform refunds, and cannot approve, deny, or guarantee any refund. All refund requests for App Store purchases must be submitted through Apple's official tools, including https://reportaproblem.apple.com or Apple Support. Apple decides refund eligibility under Apple's rules and applicable consumer law.
If Apple-managed trials, introductory offers, promotional offers, discounts, family sharing, or other billing variants are available, the terms shown by Apple at the time of purchase will apply.
8. Restore Purchases
The Restore Purchases function asks Apple and RevenueCat to refresh purchase and entitlement state for the app. Restore Purchases does not create a new purchase, cancel a subscription, or request a refund. Refunds and cancellations remain Apple-only workflows as described above.
9. Changes to features and prices
We may change free or paid features, product identifiers, subscription options, prices, limits, content availability, eligibility, and Service functionality from time to time. If required by law or platform rules, we or Apple will provide notice of material subscription changes.
Some features may depend on device compatibility, internet access, Apple services, backend availability, paid-access status, device permissions, language support, recognition-provider availability, or third-party providers.
10. User content and permissions
You may provide information, text, photos, receipt or product images, support messages, feedback, preferences, saved content, and other content through the Service ("User Content").
You retain ownership of your User Content. You grant us a limited, worldwide, non-exclusive license to host, process, transmit, analyze, display, and use User Content only as needed to provide, secure, maintain, improve, and support the Service, comply with law, enforce these Terms, operate the features you request, and handle support, legal, and privacy requests.
We do not claim ownership over your private food inventory, shopping list, recognition images, recognition edits, saved recipes, nutrition setup, or support messages. Personal data is handled under the Privacy Policy.
You are responsible for ensuring that your User Content does not violate law, infringe anyone's rights, contain harmful or abusive material, or include information you do not have permission to provide. You should avoid uploading receipts or photos that show unnecessary personal, financial, payment-card, or third-party information.
11. Recognition, OCR, and AI-assisted features
Receipt and product-photo recognition is optional and should be started by you. Recognition suggestions must be reviewed before they are saved or relied on.
OCR, computer-vision, and AI-assisted features may misread text, identify the wrong product, miss items, duplicate items, infer the wrong quantity, unit, brand, price, expiration date, ingredient, allergen, nutrition value, or dietary category, or fail to return a useful result.
When proxy-assisted AI is enabled, recognition may use backend services and providers such as OpenAI through an In My Fridge-controlled proxy. These features may be wrong, incomplete, repetitive, outdated, or unsuitable for your situation. You should not rely on them for food-safety, allergy, medical, diet, emergency, or high-stakes decisions.
12. Food safety, allergies, nutrition, and cooking responsibility
Recipes, ingredient matches, missing ingredient lists, shopping suggestions, nutrition values, calories, macros, serving sizes, dietary flags, recognition results, cooking steps, and timers are provided for information and convenience only.
You must independently verify ingredients, quantities, allergens, dietary restrictions, cooking instructions, storage conditions, expiration dates, product labels, and food safety before cooking, eating, serving, storing, or purchasing any product.
The Service cannot determine whether food is fresh, safe, uncontaminated, properly cooked, or suitable for your diet. Users with allergies, medical dietary needs, pregnancy-related needs, diabetes, eating disorder history, medication interactions, or other health concerns should consult a qualified professional before relying on recipes, nutrition data, or food suggestions.
13. Acceptable use
You agree not to:
- use the Service for unlawful, harmful, abusive, fraudulent, exploitative, or unsafe purposes;
- attempt to reverse engineer, copy, scrape, modify, resell, or interfere with the Service;
- bypass subscriptions, entitlements, quotas, rate limits, safety limits, or access controls;
- submit content that infringes rights, violates privacy, or is illegal;
- upload receipts, labels, photos, or text you do not have the right to use;
- use the Service to seek or provide medical, allergy, food-safety, emergency, clinical, legal, financial, or other regulated professional advice;
- use the Service to make high-stakes decisions without independent verification;
- interfere with the security, availability, or integrity of the Service.
We may restrict or terminate access if we reasonably believe you violated these Terms, law, platform rules, safety limits, or the rights of others.
14. Intellectual property
The Service, including software, app design, text, graphics, logos, trademarks, source materials, curated recipe content, generated templates, and other content provided by In My Fridge or its licensors, is owned by In My Fridge or its licensors and is protected by intellectual property laws.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use on devices you own or control.
You may not copy, distribute, sell, rent, sublicense, modify, reverse engineer, or create derivative works from the Service except as allowed by law or expressly permitted by us.
15. Third-party services
The Service may rely on or link to third-party services, including Apple services, StoreKit, Sign in with Apple, iOS notification systems, camera and photo-library features, Apple Maps or map providers for nearby grocery store functionality, RevenueCat for purchase entitlement state, PostHog for privacy-safe product analytics, optional Sentry diagnostics when enabled, OpenAI where backend AI processing is enabled for requested recognition features, backend/cloud hosting providers, and email or support providers.
We are not responsible for third-party services, websites, terms, policies, outages, decisions, or content. Your use of third-party services may be subject to their own terms and privacy policies.
16. Apple App Store terms
If you download or use In My Fridge through the Apple App Store, these Terms are between you and In My Fridge, not Apple. Apple is not responsible for the Service or its content.
Your use of the Service must also comply with the Apple Media Services Terms and any other applicable Apple rules. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.
If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, according to its policies. To the maximum extent permitted by law, Apple has no other warranty obligation for the Service.
17. Privacy
Our Privacy Policy explains how we collect, use, share, and protect personal data. By using the Service, you acknowledge that personal data is processed as described in the Privacy Policy.
18. Service availability
We may change, suspend, interrupt, limit, or discontinue any part of the Service at any time. We do not guarantee that the Service will always be available, secure, uninterrupted, timely, error-free, or compatible with every device, operating system, location, language, subscription state, or Apple account state.
We are not liable for loss of access, loss of data, Apple billing issues, RevenueCat entitlement delays, outages, provider failures, device failures, network issues, unavailable features, food spoilage, purchase mistakes, cooking mistakes, or app review/platform limitations, except where liability cannot be excluded by law.
19. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.
We disclaim warranties of accuracy, reliability, completeness, fitness for a particular purpose, merchantability, non-infringement, availability, and suitability for your circumstances.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
20. Limitation of liability
To the maximum extent permitted by law, In My Fridge will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of data, loss of goodwill, food spoilage, purchase mistakes, cooking errors, nutrition mistakes, allergen exposure, health outcomes, safety outcomes, or reliance on Service content.
To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid to In My Fridge for the Service in the 12 months before the claim arose, or USD 50 if you paid nothing, unless a different limit is required by law.
21. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless In My Fridge from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your User Content, your violation of these Terms, or your violation of law or third-party rights.
22. Governing law and disputes
These Terms are intended to be governed by the laws of Georgia, except where mandatory consumer protection, data protection, platform, or other laws in your country of residence require otherwise.
Before bringing a formal claim, you agree to contact us at Yaromaum@gmail.com and try to resolve the dispute informally. We will try to respond within a reasonable time.
Nothing in these Terms limits mandatory rights you may have under laws that apply to you.
23. Termination
You may stop using the Service at any time. If you have an active Apple-managed subscription, you must cancel it through Apple to stop future renewals.
We may suspend or terminate access to the Service if you violate these Terms, misuse the Service, create risk for In My Fridge or others, or if we discontinue the Service.
Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnity, governing law, dispute provisions, and Apple billing/refund provisions.
24. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will provide notice through the Service, hosted pages, email, or another reasonable method where required by law.
The updated Terms become effective when posted or on the date stated in the notice. If you continue using the Service after changes take effect, you accept the updated Terms.
